Acceptance of Contract Terms
By accessing this web site and/or purchasing products from HTC, you agree that you have read, understood and agree to be bound by all of the provisions set forth herein and below (collectively, the "Terms and Conditions"), all of which constitute an agreement between you and HTC Tool-Cutter Manufacturing The unenforceability of any one of the Terms and Conditions shall not affect the enforceability of any of the other Terms and Conditions. The terms and conditions on any quotation, order acknowledgment, invoice or other form you receive from HTC Tool-Cutter Manufacturing are incorporated into these Terms and Conditions by reference. These Terms and Conditions constitute the exclusive agreement between you and HTC Tool-Cutter Manufacturing, except as otherwise agreed in writing signed by us. Our failure to assert a right or insist upon compliance with any term or condition shall not constitute a waiver of that right or excuse any subsequent noncompliance. HTC reserves the right to change these terms and conditions by posting a revision on this website.

Limitation of Liability
Under no circumstances shall HTC Tool-Cutter Manufacturing be liable in contract, warranty, tort or otherwise for any special, exemplary, incidental or consequential damages that result from your purchase of any products from HTC Tool-Cutter Manufacturing or any use of or the inability to use any content or products from HTC Tool-Cutter Manufacturing In no event shall our liablity exceed the purchase price of the products you purchase from HTC Tool-Cutter Manufacturing It is the users responsibility to inspect all products to determine if they are per specification required by the end user.

Cutting tools
By its nature cutting tools are dangerous and can be unpredictable. Cutting tools can break and shatter with great force. While cutting tools are used they can release chips, swarf, dust, sparks, fire and gases. It is the users responsibility to determine proper and safe protection from said cutting tool. Eye protection, machine guarding, ventilation equipment, fire protection and other misc safeguards must always be used effectively and must be maintained and tested. In no way shall HTC Tool-Cutter Manufacturing be liable for any costs, machine down time, injuries, or deaths resulting from a cutting tools breakage or emissions.

JURISDICTION AND CHOICE OF LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan applicable to contracts made and to be performed in Michigan, without giving effect to conflict of law principles, and applicable federal law. Any personal information submitted will be subject to these laws, not those of any jurisdiction outside of the United States. You irrevocably consent to the exclusive jurisdiction of the courts located in Michigan in connection with any action arising out of or related to these Terms and Conditions or this web site. Notwithstanding the foregoing, proceedings to enforce the result of any such adjudication may be brought in any applicable forum.

Returns and Refunds

* Special orders or modifications to any tool are non-cancelable and non-refundable  

Returns are accepted within 30 days of delivery without a Returned Goods Authorization. After 30 days you must contact HTC for authorization prior to returning any items from your order. Returned items must be new, in original packaging and show no signs of wear, damage, abuse or alteration. Failure to meet these conditions may cause your request for return credit to be denied.

All refunds will be given in the originally made payment forms.

Shipping
Same day shipping: Same day shipping is available for in stock items ordered before 5:00pm E.T. Monday through Friday. 98% of our inventory is in stock at all time.

Late Delivery, Lost Delivery
In the event that the delivery carrier does not deliver your order on time or loses your order, HTC will file a claim on your behalf, but cannot be held accountable for that loss. All orders are shipped with insurance for this reason and all carriers accept full liability for these orders.

The claims processed by UPS may be up to, but not limited to 30 days after opening an investigation. In most cases packages are located and delivered as quickly as possible. Refunds for late deliveries cannot be given with the exception of guaranteed UPS Expedited Services. Those refunds are at the discretion of UPS.

Orders that cannot be located after 30 days will be refunded by the carrier you requested and upon receiving that refund HTC will prepare and fulfill a new order shipment to replace your original order or provide a full refund in the insured amount.

Website Accuracy
Accuracy is our top priority when listing our product, however, from time to time our product listings may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability*. HTC Tool-Cutter Manufacturing reserves the right to correct any errors, inaccuracies or omissions and to change or update product information without prior notice (including after you have submitted your order).
